Protect your legacy.

Protection of your legacy is the main reason why you should have an estate plan in place. If you take the proper precautions, you can ensure that your Will and Trust are honored after you die. Oftentimes, after a loved one passes, family members will try and petition the courts to change the Trust.

The main two petitions filed to set aside a Will or a Trust are:
  1. Undue Influence
  2. Mental Incompetence
This means that if a petitioner proves to the Probate Court that you were unduly influenced or that you did not have the mental capabilities to write your Will or Trust, then your legacy is no longer your own. The best solution to this problem is to write your Will and Trust while you are young, when it is harder to prove either of these factors.

Protect your parents' legacy.

The other side of this is protecting your parents' legacy. It is easy for con artists to take advantage of the elderly; they are blind to the fact that they are being taken advantage of. Alternatively, they may be subjected to elder abuse or put into a position where they feel they have no choice but to comply. If you suspect this is the case with an older family member, then you may need to step in and protect them and their legacy.
